If you host guests in Spain, Real Decreto 933/2021 requires you to register each guest with the Spanish authorities. This guide explains what the decree means for you, what you need to do to comply, and how the Holidu online check-in feature helps you submit guest data on time.

What is Real Decreto 933/2021?

Real Decreto 933/2021 is a Spanish royal decree that strengthens security in the holiday rental and car rental sectors. It sets out how accommodation providers must collect and report information about guests, properties, and bookings to the Spanish Ministry of the Interior. The decree develops Article 39 of Organic Law 4/2015 on the protection of public security, which requires accommodation providers to keep a record of their guests.

The decree came into force on January 2, 2023. A transition period ran until October 1, 2024. Since then, hosts must fully comply with the reporting rules.

How does this affect hosts?

If you rent out a property in Spain, you are responsible for registering every guest staying there. This applies no matter where you live or what nationality you hold.

You must report:

  • Host details
  • Property details
  • Guest information for all guests in a booking
  • Booking and transaction details

Holidu collects booking and transaction data for you. You are still responsible for collecting the personal details of each guest, including:

  • Full names
  • Date of birth
  • Residency address
  • Contact details (phone or email)
  • ID type and number for adult guests
  • Support document number for guests with a Spanish ID (NIF or NIE)
  • Relationship to any minors travelling with them, where applicable

Where do you report?

Most hosts report through the SES Hospedajes platform, run by the Spanish Ministry of the Interior. If your property is in Catalonia, report to the Mossos d'Esquadra. If your property is in the Basque Country, report to the Ertzaintza.

What are the penalties for non-compliance?

Late or incomplete reporting can lead to fines after the transition period. The amounts depend on how serious the breach is:

  • Minor: €100 to €600
  • Serious: €601 to €30,000
  • Very serious: €30,001 to €200,000

How Holidu helps you comply

Holidu acts as an intermediary platform. We securely store the booking data needed for reporting and send it to the Spanish authorities for you. Once a booking becomes non-refundable, Holidu reports the booking details within 24 hours. If a non-refundable booking is later cancelled, Holidu updates SES Hospedajes to withdraw the reported booking.

For guest details, Holidu's online check-in feature emails your guests a form. Guests complete it before arrival, and Holidu passes the information to the authorities automatically by 11:00 PM on the check-in day.

How to submit guest data through Holidu

Follow these steps to set up reporting:

  1. Register on the SES Hospedajes platform through the official Ministry of the Interior site, under the section "Hospedajes y alquiler de vehículos."
  2. Find the "Access to the register of HOSPEDAJES establishments and entities" option.
  3. During registration, select "Send communications via webservice."
  4. In your Holidu account, activate the Guest Online Check-in feature and choose your authority: SES Hospedajes, Mossos d'Esquadra, or Ertzaintza.
  5. Enter your login details for SES Hospedajes or your regional authority.

Once this is set up, Holidu sends guest details automatically. Check that every guest's information is complete. If anything is missing, collect it from the guest at check-in. Incomplete data can lead to fines.
